Terms of Use and Service
We reserve the right to amend these Terms at any time without notice.
Please read them before agreeing to them and using the App.
1. Definitions
“Terms of Service”, “Terms”, “ToS”, “Rules”
This document and any amendments to it hereafter.
“Platform”, “Application”, “App”
The software application this ToS governs on all offering platforms e.g. mobile/cell phones, desktops, laptops, tablets and all possible electronic viewing devices.
“We”, “Us”, “mosquito”, “mosquito.social"
The developer, developers and/or legal owners of the Application as determined in the Apps’s Principal Jurisdiction.
“Principal Jurisdiction”
England and Wales, the country in which the owner of the App, SQWZL LIMITED, is incorporated.
“Primary Language”
The foremost language in which the App is offered and supported, including in communication between Us and Users. This language is English (United Kingdom).
“You”, “User”
Anyone operating the App legally and legitimately. A User must open an Account with Us to use the App legitimately. You agree that we will not be bound by you or to you and will not be potentially accountable for any consequence of your using the App if you are not a legitimate and legal User of the App.
“Account”
The totality of data and records set up by Us that permits and allows a User to use the App, to interact with other users and with Us.
“Content”, “Post”
Any form of media or text that the App supports that a User puts up on the App and / or that a User shares on the App.
“Dormant Account”
An Account that has not posted, shared or engaged on the Platform for 360 days.
“Subscription”
A payment plan offered for use of the App.
“Single Payment”
A single one-off payment for use of the App, with specific restrictions. This may be later upgraded to a Subscription.
“Trial Period”
Use of the App, normally without payment, with specific restrictions.
“Advertising”, “Ad”
Any promotion on the App either by Us, third parties or Accounts.
“Shadow Ban”
The situation of not showing a User’s posts to other users.
“Post Ban”
The situation of not showing a specific post.
“Suspension”
The condition of restricting a User’s or Account’s activities for a period of time. Normally applies during a Shadow Ban.
“Permanent Ban”
Removal of Accounts from the App indefinitely at the instigation of mosquito. Such Accounts will not be able to use the App.
“Account Deletion”
The removal of an Account from the records of the App. Such Accounts will not be able to use the App. Account Deletions may be at the instigation of the User or may be imposed by Us.
“Bot”
Any non-human, usually automated, interaction with the App. Such Bots may or may not intend to appear to be human.
2. Jurisdiction and Legal Resolution
These terms are governed by the laws of England and Wales (Principal Jurisdiction) and under any applicable laws and statutes enforced by the distributors of the App, that is, the various App Stores.
You agree to resolve all disputes with mosquito under the laws of England and Wales in the jurisdiction of England and Wales, except for subscriptions or where local laws apply.
You agree that our interpretation of these Terms and Rules and what constitutes breakage of the Rules are final.
You agree that mosquito will not be liable for any injury, costs, liabilities, losses, financial, physical or otherwise, that arise from You using this app.
3. Accounts
Every Account must sign up with a valid email address.
A sign-up email can only be used with a single Account.
Users must be at least 18 (eighteen) years of age. By using the App you affirm, truthfully, that you are at least 18 years old.
Users must be legally permitted, in the jusrisdiction the App was installed, to use the App on their own behalf.
You cannot accept these Terms on someone else’s behalf.
Accounts must be held and operated by humans or by organisations with clearly identifiable human administrators.
Bots are banned from the App and Accounts that are either bots or act like bots or that mosquito, after careful review, decide are bots will face an immediate Permanent Ban.
Accounts linked to phishing activities, primarily auto-generated content (“slop” using AI or other), disinfomation, misinformation, fraudulent or suspisciously fraudulent activities, grooming, non-approved sales or advertising campaigns, rage-baiting or in any vein similar to all the afore-mentioned will be permanently removed.
Users agree to not mis-represent or mis-characterise themselves on the App.
You agree to not use or attempt to use another User's account.
You agree that you will not decompile or reverse-engineer this Application or attempt to do so.
Accounts that fail to abide by these Rules may, after due warning, face a Shadow Ban or an immediate Permanent Ban. You agree that mosquito reserves the exclusive right to make this decision.
Accounts that We determine are acting in concert with other accounts to break these ToS may face a Shadow Ban or an immediate Permanent Ban. You agree that mosquito reserves the exclusive right to make this decision.
4. Copyright and Intellectual Property
You retain the copyright for your original Content posted on the App.
Any use of other people’s copyrightable material must be either with permission, under fair use and must be properly accredited.
If we would like to use your images for marketing of the Platform, outside of the Platform, we will contact you for terms and permission before doing so and will only proceed with your permission and agreement.
Notwithstanding the foregoing, you grant us the right without financial consideration to use your Content, on the App itself, to indicate content available on the App; for example, and not limited to, splash screens on the App itself or such use on the App’s or App’s parent’s website.
Any use of User’s Content will be appropriately credited to the copyright holder/s.
5. Posts
You agree to only post Content that is your own copyright, or to which you have the copyright holder’s consent to post, or to only use content that can be considered acceptable under fair use. All such “fair use” should be credited to the person who created the visual image and/or the copyright holder/s.
You agree to remove all content where the copyright holder requests that you do so. Failure to do so may result in your Account being suspended.
Accounts that repeatedly violate other people’s copyright will face a Permanent Ban, that is, be deleted.
Where sub-clause (1) is not convenient e.g reposting an image of a well-known photographer, living or dead, you agree to give proper credit either to the copyright holder, the photographer and/or to the platform from which the post was copied.
You agree to correct any improper accreditation in a reasonable amount of time which should be taken to be within 48 hours of such notification.
You agree that if you do not remove said work within a reasonable period (typically 48 hours) that we can Post Ban or remove such posts if we determine.
You agree to not scrape content from the App.
You agree that all visual images that give the impression to be or that can be mistaken as reality are in fact of situations that happened in reality and witnessed by a human or a device, such as a camera, present when the actions happened.
You agree to classify any artificially derived image (so-called AI image) as such except where it is obvious to any reasonable person that it is so within the context of its presentation. For example, an image of people dining on a faraway planet is obviously, presently, artificial. An image of a person doing something they could realistically have done is not always obviously artificial. Do not mis-represent an image as if it happened when it didn’t, no matter how realistic the image.
Posts that suggest, in image content and/or text, that the Poster is under 18 years old will be banned and the Account removed from the platform.
You agree Posts that do not abide by these Terms may be hidden via a Post Ban or removed without warning.
Do not post pornographic images of any kind. This includes but is not limited to images of genitals i.e sexual organs below the waist as well as images that are ordinarily taken to be "porn" whether or not they involve genitals. “Ordinarily seen” is interpreted here as viewed in the United Kingdom.
The above does not preclude sharing images of nudity or art photos. There is a fine line between erotic and sexual but there is a wide gulf between sensual images and porn. Use your good judgement but note that accounts that only or predominantly show nudity, and that we judge as "across the wide gulf" may be removed. Our decision on this will be final.
In responding to someone else's posts, keep to the topic. Do not hijack the topic for a different purpose; for example if an original post is on, say, flowers, food, travel, portraiture, street photography and you respond in comment on politics and current affairs not referenced in the post or about the guru that helped you find love or make money etc. that is a hijack. Accounts that do this will be banned.
Do not share personal phone numbers. Mosquito does not currently have a direct messaging (DM) feature.
Do not solicit for sex, drugs, human trafficking on the App.
Do not post images of weapons, class A drugs or of any of the sorts of materials you are not allowed to possess onboard a commercial passenger air flight.
If you would like to place Ads then please contact us at contact@mosquitosocial.com. Only Ads approved by us can be shown to Users that are not your followers. Posts flagged as Ads may be restricted.
We may use internal labels of our choice to categorise Posts as a way of determining how posts may be delivered.
Mosquito does not does not tolerate any content depicting child sexual abuse and exploitation (CSAE), including content or behavior that sexually exploits, abuses, or endangers children. This includes, for example, grooming a child for sexual exploitation, sextorting a child, trafficking of a child for sex, or otherwise sexually exploiting a child. Any such images on any of our platforms and apps will be promptly removed and accounts that post such images will be suspended and reported to the relevant authorities.
Mosquito will not tolerate any graphic content depicting sexual abuse or exploitation of any person, where such depiction is clearly not related to a news story in the public interest e.g. part of an investigative inquiry. Similar content aimed solely at vicarious gratification or embarrassing others, for example, but not limited to "revenge porn" or images using AI tools to undress people, will be promptly removed and accounts that post such images will be sanctioned; and where required, reported to the relevant authorities.
6. Artificial Intelligence (AI)
We will not create bots or AI personalities or deep fakes or any such technology that pretend to be human to engage with you outside of Support and Help features.
We will not abuse your copyright and intellectual property by training AI models with them for our financial benefit. We believe that's theft, certainly when done without your permission. While we can't foresee the future around AI applications and law, any use of your data by us for AI will come with your express permission.
Notwithstanding the above, we reserve the right to use content on the platform for AI training purposes to monitor use of the App. An example is training AI models to flag content that might contravene these Terms of Service e.g. pornography, child abuse, sale of weapons etc.

7. Free Speech
You agree not to rage-bait, bully, doxx, threaten other Users or use the App as a platform to do so to non Users. This does not affect your rights to freedom of expression but such freedoms come with responsibility.
Mosquito will not enter into or engage in disputes on Free Speech. All Free Speech is almost bound to upset someone and we do not intend to ban such speech where they do not, within common sense understanding and/or legal advice, break applicable laws.
However making Free Speech on Mosquito comes with boundaries. If those boundaries are unacceptable to you You are free to delete your account and leave the platform.
Be courteous. You do not have to agree with posts and you are free to disagree or raise counter opinions. However accounts that directly threaten the safety, lives and occupation of others will likely be sanctioned and banned, irregardless of how “in the right” the User claims to be or what side of the political, moral, religious, cultural spectrum or divide they are.
Do not abuse the Report Abuse mechanism on the App. Accounts that are deemed to abuse the mechanism may be banned. As example, reporting posts and accounts that engage in phishing, grooming etc is appreciated. Reporting accounts because you don’t like a person or another acount is not.
Mosquito will not immediately label Content any User disagrees with as “hate speech” except supported by legal advice. If you just don't like an opinion, counter it or ignore it or unfollow.
8. Privacy
We do not harvest your data.
We do not share any of your data with any other “partner” outside of mosquito and its parent/s and their subsidiaries.
We will not sell your data to or exchange it with any third party. This does not preclude processing your data or preferences on the platform for ads or promotions on the platform.
Unless required by law we do not keep your data if your Account is deleted.
We may ask to access your camera and microphone (where appropriate) and media library so you can post media content.
We may seek to access your location to facilitate security protections and to better understand how you use the App.
We do not and will never seek to access your messages, calendar, reminders and contacts.
We do not collect or attempt to collect any data from any other app or location on your device.
We are a business service operating within the legal framework offered by England and Wales. We will, under legal advice, give up any data we have about you, upon request, to law enforcement agencies in the United Kingdom.
Presently, mosquito has no data encryption messaging. We encourage you to never share sensitive information on the App or information that you would like to remain private but likely to attract attention from law enforcement. There are other tools and apps for that. Use them.
9. Suspensions
Suspensions may be temporary (Shadow Ban) or permanent (Permanent Ban). Accounts will be informed about bans and why when they take effect. Generally, offending Accounts will initially face Shadow Bans or a Post Ban. Persistent offenders will face a Permanent Ban. Some contravention of these Terms may be deemed egregious enough to warrant an immediate Permanent Ban.
Mosquito and its parent company or companies will not enter into any consultations about bans.
Post Bans
These bans are of specific posts. They are permament even if the post is subsequently revised. They do not affect the rest of a User’s posts not under such bans.
Shadow Bans
These bans are temporary and apply to an Account. There are four Shadow Ban periods of increasing length. Bans start at Level 1 and progress through to Level 4. Accounts that post Content or engage in actions that violate this ToS start with a Level 1 ban. Any further violation within 360 days of the end of a Ban trigger a new Ban at the next Level. Accounts that exhaust all Levels face a Permanent Ban.
Accounts that are shadow banned can still use the App. The User will not be able to engage with other Content during the ban but will be able to add and edit their own pages.
While Shadow Banned none of the User’s posts will be shared with other users. Other users will still be able to see the User’s posts, that are not under Post Bans, when they visit the User’s page.
Subscriptions that span a Shadow Ban are entitled to a refund where the ban is greater than 30 days. Abuse of refund policies may lead to your account being removed and permanently disallowed on the App.
Ban Periods:
Level 1: 3 days
Level 2: 10 days
Level 3: 30 days
Level 4: 90 days
Permanent Bans
Accounts that are permanently banned will be removed from the Platform. Such accounts may not be re-opened.
10. Subscriptions
Subscriptions are offered according to the terms of the subscription agreement Users selected when subscribing.
Recurring subscriptions or one-off subscriptions/payments do not give Users the right to post Content that contravene these Terms.
11. Dormant Accounts
Mosquito is not a content storage service. As a result we cannot indefinitely store Users content at no charge. Dormant Accounts will be informed of the dormancy of their accounts and given a set time, normally 90 days, to re-engage on the Platform. Accounts that have not paid recurring subscriptions for the previous three months or that do not sign up for recurring subscriptions within 30 days of the notice, and fail to re-engage on the Platform within the given time will be deleted by mosquito including all of their data and content.
12. Our Commitment
We commit to minding your privacy. We will not request or collect your private data or activities beyond what is strictly necessary e.g. your email address for Account creation; location for security reasons, activity logs on the App etc. Your personal life details, not posted by you on our Platform/s, is none of our business.
We will not track you across the internet or other platforms. What you do outside mosquito is none of our business.
We will never contact you, within or outside the App, to request any personal details or your password or recovery code.
We will not use your device to surreptitiously record or capture any audio or video activities.
We will not ply you with algorithms designed to keep you addicted or enraged or get you radicalised etc. under the pretense of providing you with a better service or for any other reason.
We may use algorithms for content discovery features and User Follow suggestions. We may also use algorithms for delivering advertisement and promotions and for communication considered to be in the public interest.
We commit to showing you all of the posts shared by all of the people you follow subject to any restrictions we deem appropriate.
We do not commit to making posts go viral. They may or they may not.
The App service is provided on a best efforts basis. We cannot guarantee and do not offer a 100% availability service. Sometimes the internet goes down and there is nothing we can do about it.
